Cadet receives nine-month sentence

Cadet 1st Class Sterling Barnes pleaded guilty and was sentenced Oct.1 by general court-martial to nine months confinement, dismissal from the Air Force, and forfeiture of all pay and allowances.

Barnes was charged Sept. 17 with violating the Uniform Code of Military Justice. Charges included:

-- Violating Article 92, Failure to Obey a Lawful Order or Regulation. He was charged with using government-provided hardware and software to advertise and sell pornography for commercial gain. The charge also included viewing, displaying and storing obscene material using government-provided equipment.

-- Violating Article 133, Conduct Unbecoming an Officer and a Gentleman, for engaging in sexual intercourse with women while other men were present.

-- Violating Article 134, Pandering, by arranging for another man to engage in acts of sexual intercourse with a woman. This action is prejudicial to the good order and discipline of the armed forces.

Barnes pleaded guilty to all charges and specifications after waiving his rights to an Article 32 hearing and trial by jury -- all as part of a pretrial agreement. Without the agreement, the maximum punishment was 14 years confinement, dismissal from the Air Force, and forfeiture of all pay and allowances.

For a cadet, dismissal is the equivalent of a dishonorable discharge, and the court-martial conviction is a federal conviction.

The case will next be reviewed by the general court martial convening authority, Lt. Gen. John Rosa, academy superintendent.
